Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CompTracer platform and website at thecomptracer.com, operated by CompTracer LLC ("CompTracer," "we," "us," or "our"). By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use the service.

The Service

CompTracer is a market intelligence platform for multifamily real estate professionals. It automatically collects publicly available apartment availability and pricing data from competitor property websites, stores it historically, and delivers weekly reports to subscribers. The platform is intended to help users understand market conditions — it is not a rent-setting tool, revenue management system, or investment advisory service.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of material changes when possible.

Account Registration and Security

To use CompTracer, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

• You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organization.
• You agree to notify us immediately at hello@thecomptracer.com if you suspect unauthorized access to your account.
• Each account is for a single organization. You may not share your account credentials with users outside your organization.
• We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree to use CompTracer only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the platform in any way that violates applicable laws or regulations.
• Attempt to access, scrape, or extract data from the platform through unauthorized means, including automated scripts, bots, or crawlers beyond normal platform use.
• Reverse engineer, decompile, or attempt to derive the source code or underlying architecture of the platform.
• Use the platform to build a competing product or service.
• Resell, sublicense, or redistribute access to the platform without our prior written consent.
• Transmit any content that is unlawful, harmful, or otherwise objectionable.

Payment, Billing, and Cancellation

CompTracer offers subscription plans billed monthly or annually. By subscribing, you authorize us to charge your payment method on a recurring basis at the rate applicable to your selected plan.

• Monthly plans renew automatically each month. You may cancel at any time; your access continues until the end of the current billing period.
• Annual plans renew automatically each year. You may cancel at any time; your access continues until the end of the current annual period.
• Upgrades take effect immediately. For monthly plans, your new rate applies at the start of your next billing cycle — you are not charged mid-cycle. For annual plans, you are charged a prorated amount for the remaining days in your current annual period at the time of upgrade.
• Refunds are not provided for partial subscription periods, except where required by applicable law. If you believe you were charged in error, contact us within 30 days at hello@thecomptracer.com.
• We reserve the right to change pricing with 30 days' advance notice. Continued use after the effective date constitutes acceptance of the new pricing.

Payments are processed by Stripe. We do not store your payment card information. Stripe's terms and privacy policy apply to payment processing.

Data Ownership

Your data: Any data, reports, or configurations you create within the platform belong to you. We do not claim ownership of your account data or the market intelligence reports generated for your organization.

Our platform: CompTracer owns the platform, software, algorithms, design, and underlying technology. Nothing in these Terms grants you a license to any intellectual property beyond the right to use the service as described.

Upon termination of your account, you may request an export of your historical data within 30 days. After that period, we are not obligated to retain it.

Data Accuracy Disclaimer

No Investment Advice

CompTracer provides market data and competitive intelligence tools. Nothing on the platform or in any report, email, or communication from CompTracer constitutes financial, investment, legal, or tax advice. We are not a registered investment advisor, broker-dealer, or financial planning firm.

Users are solely responsible for their own business and investment decisions. You should consult qualified professionals before making significant financial or real estate decisions.

Limitation of Liability

To the maximum extent permitted by applicable law, CompTracer and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to these Terms or the platform shall not exceed the amount you paid to CompTracer in the three months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless CompTracer and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the platform, your violation of these Terms, or your violation of any third-party rights.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the date at the top of this page and, for material changes, provide notice by email or within the platform. Your continued use of the platform after the effective date constitutes your acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of the State of Arizona.
